1) Term of Agreement
This agreement shall be effective on the date of execution and continue through to the next successive twelve month period ending on the day before the anniversary day.
2) Responsibilities.
2.1) It is the sole responsibility of the customer to read this agreement carefully and ensure that all products purchased are accurate. Any grievance must be presented to Easy Domains within seven days from the purchase date. Any errors highlighted after that may be subject to a charge. All customer details must be accurate for any purchase if Easy Domains find that client information is incorrect or used for any unlawful activity the contract may be subject to immediate termination without refund. Easy Domains will endeavour to deal with all complaints through their internal grievance procedure. A resolution period will depend on the complexity of the issue at hand.
2.2) Easy Domains will be responsible for ensuring that all customer information is listed in whole and not in part. If an error is made on our part, we will ensure that it is corrected at the point of highlight or realisation. Easy Domains will manage all domains on behalf of the client, and any technical changes will be dealt with by our support team within 24 working hours of notification.
3) Domain Name
3.1) Each domain name purchased from Easy Domains comes with a twelve-month registration from the time of purchase. Each domain name acquired will need renewing two weeks before the end of the twelve-month registration.
3.2) If a domain name is not renewed in the given period it will expire from the customer's account.
3.3) If a customer has more than one domain name, they can choose to renew all domain names in a yearly bulk price.All domain names can be pointed to another website or server via a 301 redirect, nameservers or A record. A change of a domain name in DNS settings can be completed instantly via the user's control panel.
3.4) Easy Domains will ensure that a customer is reminded of their domain or hosting renewal date. Easy Domains will be in contact up to 2 months before the renewal date.
3.5) Domain names can only be transferred out to another registrar 60 days after the purchase date. For more information, please read section 4.
3.6) A domain name renewal is charged automatically two weeks before the anniversary of the purchase date.Each Domain name comes with an account manager which will assist you with any requirements you may have.Any domain registered will be owned by and registered to the customer.
4) Domain Transfers
4.1) Any newly purchased Domain names can only be transferred out to another registrar 60 days after the original purchase date. If a domain is renewed after it has expired the domain will be subject to another 60-day transfer hold. Full Domain management privileges will still be available during this time.
4.2) Domain names will be transferred out Free of Charge if a request is made within 120 days of the original purchase date. If a domain is requested for transfer after 120 days there will be an administration charge of £9.99 plus VAT per domain name.
4.3) We do not charge any administration charges when transferring in a domain.
4.4) The customer must cover any additional transfer fees from third parties.
4.5) Easy Domains will not be liable for any Domains submitted to an incorrect IPS TAG or Administrator which is by the fault of the client or approved web services provider.
4.6) If a copy of your website is required, this must be requested before the transfer of the domain begins. There will be an administration fee for website transfers, and this cost will depend on the size of the website.
5) Emails
5.1) Email address are included with each domain purchase and can be setup via the user's control panel.
5.2) Email address are supplied with 5GB disk space as standard and can be upgraded up to 50GB via your control panel.
5.3) Each domain purchased with Easy Domains will allow the customer to create 50 personal email addresses on that specific domain name
5.4) Easy Domains emails are a self-managed service. Easy Domains will not be held accountable for any loss of data incurred by the client.
5.5) All email accounts will be stored on the Easy Domains Mail server. This server can be taken down at any time for maintenance updates which could last for several hours.
5.6) Easy Domains hold the right to remove any accounts without notice if a user is found to be sending spam or fraudulent emails. Refunds will not be given for the remaining time on the contract.
5.7) By using the Easy Domains emails you are automatically agreeing to a fair usage policy. Mass mail-outs will not be tolerated unless otherwise agreed with Easy Domains.
6) Website Creation
6.1) All Easy Domains websites are designed and built in-house using our bespoke Content Management System Easy Sites. This will allow you to update your site after completion.
6.2) All material you would like to include on the website should be sent to support@easydomains.uk. Easy Domains will not be held responsible for material emails going to spam.
6.3) Within ten working days (usually much sooner), you will receive a phone call from your account manager to discuss the creation of your website. If we are unable to contact you after three attempts, your site will be started and completed with generic information we have. We will then continue to contact you for a further ten days before your website is submitted to the search engines.
6.4) You will be assigned a dedicated website designer who will create the content to your specification and customise a pre-built template to your specification.
6.5) Easy Domains aim to complete a website within six weeks of being assigned to a Designer. We can not guarantee this time frame as it may change depending on the customer's specifications or the amount of material the customer has supplied, as well as other unforeseen circumstances.
7) Website Hosting
7.1) All websites built by Easy Domains are hosted by our content management system (Easy Sites). Please read section 10 to learn more about Easy Sites.
7.2) FTP access has been disabled on websites built by us. This is to ensure the security of all customers and their sites. In your account, you have the option to move to a standard FTP account where you can upload your custom website.
7.3) Easy Domains can schedule unannounced server maintenance to help improve our hardware and services. Any known/scheduled downtime will be listed onstatus.easysites.uk
8) Search Positions
8.1) We can not guarantee first page positions for any website created by Easy Domains due to the level of competition in some areas.
8.2) Easy Domains will create a search engine friendly website with unique content unless otherwise instructed by the customer.
8.3) Easy Domains recommend targeting smaller geographical areas and long tail keywords for all new websites. Targeting larger areas can be attempted at the customer's risk.
8.4) All of our websites are built in Easy Sites which allows you to update your website. It is a fact that websites which are updated more frequently with new content rank quicker and better than sites that are never updated at all.
8.5) Duplicate content will cause an adverse effect on search positions. Plagiarising content from any online source will severely impact your search rankings, even if it has come from your very own website. If a customer adds duplicate content to a website, Easy Domains can no longer optimise the site for the search engines.
9) Images
9.1) Easy Domains pay a licence fee to use stock images on your website. This license will only cover your websites undertaken and hosted with Easy Domains.
9.2) Easy Domains do not hold any responsibility for any images supplied by the customer. If you choose to use copyrighted images on the website, you do so at your own risk.
10 ) Easy Sites
10.1) Easy Sites is a Content Management System which is owned and regularly maintained by Easy Domains.
10.2) Easy Sites is free for an active customer to use. Website renewals must be up-to-date.
10.3) Easy Sites is owned by Easy Domains, if you transfer your websites away from Easy Domains you will lose access to Easy Sites.
10.4) Easy Sites allows you to easily manage your website.
10.5) Easy Sites can be taken down at any time for maintenance updates which could last up to 48 hours.
10.6) Easy Domains may suspend your website and access to Easy Sites in the event of unpaid services. Services will be resumed upon payment for services.
11 ) Google Adwords
11.1) Easy Domains will manage your AdWords account to make sure that you are receiving the best amount of exposure for your budget.
11.2) Due to the competition in some areas, depending on the individuals budget we cannot guarantee first page positions.
11.3) Your budget will be divided up over each day in the agreed timescale.
11.4) Your advertisement will be taken down automatically when it hits its daily budget.
11.5) After the first month on AdWords Easy Domains will analyse your report and tweak your advertising budget.
12) Return and Refund Policy
12.1) If a service has been requested and paid for, no refund will be given after 14 days if the customer backs out, unless work has not yet started.
12.2) As per registry policy, all domain name registrations and renewals are final. No refunds are given on successful domain registrations or renewals.
12.3) Once a domain name has been registered we are unable to alter them in name or extension, should additional domains be requested they will be chargeable at the current market rate plus admin fees.
12.4) No refunds will be given on AdWords.
12.5) We will work with our customers to help ensure they are pleased with the work produced. In the unlikely event that Easy Domains are unable to satisfy the customer's needs, cancellation of the project must be made in writing by the customer. In the event that work is postponed or cancelled at the request of the Customer, we reserve the right to retain a fee on the percentage of work completed.
12.6) If we receive a chargeback or payment dispute from a credit card company or bank, your service and project will be suspended without notice. A £100 chargeback fee (issued to recover fees passed on to us by the credit company), plus any outstanding balances accrued as a result of the chargeback(s) must be paid in full before service is restored, files delivered, or any further work is done.
12.7) Instead of issuing a chargeback, contact us to address any billing issues. Requesting a chargeback dispute for a valid charge from us is fraud, and is never an appropriate or legal means of obtaining a refund.
12.8) Please read and make sure you fully understand our refund policy prior to making a payment.
12.9) Easy Domains will not provide compensation due to any errors or downtime incurred on any products or services unless otherwise stated by Easy Domains.
